Terms & Conditions

1. Who we are

Poetic Memory (the "Service") is operated by Trinity Johnson, a sole proprietor based in the United States of America ("we", "us", or "our"). By accessing or continuing to use the Service, you agree to these Terms & Conditions ("Terms"). If you do not agree, do not use the Service.

2. Eligibility & accounts

You must be of legal age in your jurisdiction to use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms. You are responsible for safeguarding your account credentials and for all activity under your account, and you must provide accurate information and keep it current.

3. The Service

Poetic Memory is a generative AI product that produces short poems based on prompts and inputs you provide. Free accounts may generate a limited number of poems per day; paid plans unlock additional features such as saving, favorites, collections, library search, and exports.

4. Acceptable use

You agree not to misuse the Service. You must not:

  • use the Service for unlawful purposes, fraud, or spam;
  • infringe the intellectual property, privacy, or other rights of any person;
  • attempt to probe, scan, scrape, overload, or otherwise interfere with the security or integrity of the Service;
  • upload malware or use the Service to distribute malicious content;
  • generate content that is illegal, harmful, hateful, harassing, sexually explicit involving minors, or that promotes violence;
  • use the Service to create deepfakes or impersonate any real person without their consent;
  • attempt to jailbreak, reverse engineer, or circumvent the technical limits or safety filters of the Service.

5. Generative AI — inputs & outputs

You are responsible for the prompts you submit, for how you use the poems produced, and for ensuring you have the rights to any content you input. You should review and verify outputs before relying on them; outputs may be inaccurate, incomplete, or unsuitable for any particular purpose and are not a substitute for professional advice (legal, medical, financial, or otherwise).

We reserve the right to remove or restrict content, refuse or filter outputs, and suspend accounts that violate these Terms. If you believe an output infringes your rights, contact us at hello@poeticmemory.com and we will review and act on legitimate complaints. Repeated infringement will result in termination.

6. Intellectual property

The Service, including its software, design, branding, and documentation, is owned by Trinity Johnson and protected by intellectual property laws. Subject to these Terms, you are granted a limited, non-exclusive, non-transferable right to use the Service for its intended purpose. You may not resell, redistribute, or sublicense the Service. You retain ownership of the inputs you submit and the outputs you generate, subject to applicable law.

7. Payments, subscriptions & taxes

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, currency, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms.

Paid plans renew automatically at the interval shown at checkout until you cancel. You may cancel at any time; cancellation takes effect at the end of the current billing period and you retain access until then. See our Refund Policy.

8. Service level & warranties

The Service is provided "as is" and "as available". We do not guarantee that the Service will be uninterrupted, error-free, or secure, and we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

9. Limitation of liability

To the maximum extent permitted by law, our aggregate liability for any claim arising out of or relating to the Service is limited to the amounts you paid to us in the twelve (12) months preceding the claim. We are not liable for indirect, incidental, consequential, special, or exemplary damages, including loss of profits, data, or goodwill. Nothing in these Terms limits liability that cannot be excluded by law, including for fraud, death, or personal injury caused by negligence.

10. Indemnity

You agree to indemnify and hold us harmless from claims arising out of your content, your use of the Service in violation of these Terms, or your unlawful conduct.

11. Suspension & termination

We may suspend or terminate your access for material breach of these Terms, non-payment, suspected fraud or security risk, or repeated or serious policy violations. You may stop using the Service at any time. Upon termination, your right to use the Service ends; you may request an export of saved poems within 30 days of termination, after which we may delete your data.

12. Governing law

These Terms are governed by the laws of the United States of America and the State in which Trinity Johnson resides, without regard to conflict-of-laws principles. Disputes will be resolved in the courts of that jurisdiction, unless otherwise required by applicable law.

13. Changes

We may update these Terms from time to time. Material changes will be communicated through the Service or by email. Continued use after a change constitutes acceptance.
